Today, it is a strategic advantage. European businesses want more than low costs and performance \u2013 they want trust. They want to know their data is governed by European law, not exposed to extraterritorial demands.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sch\u00e4fer points out that this shift has been accelerated by global politics:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe geopolitical developments of the past year have changed everything. European sovereignty in the cloud isn\u2019t optional \u2013 it\u2019s a core necessity.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Arno Sch\u00e4fer, CEO at UpCloud<\/strong><\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\">The Sovereignty Illusion of U.S. Providers<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In response to European demand, U.S. hyperscalers have launched \u201csovereign\u201d offerings marketed on four pillars:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Data Residency<\/strong> \u2013 storing data exclusively in EU-based data centers.<\/li>\n\n\n\n<li><strong>EU-Only Access and Operations<\/strong> \u2013 restricting technical support and operations to EU staff.<\/li>\n\n\n\n<li><strong>Encryption &amp; Key Management<\/strong> \u2013 services like BYOK (\u201cBring Your Own Key\u201d) or HYOK (\u201cHold Your Own Key\u201d).<\/li>\n\n\n\n<li><strong>Local Partnerships<\/strong> \u2013 independent partner clouds legally anchored in the EU.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">At first glance, these measures seem reassuring. Yet they cannot overcome one decisive fact: the U.S. Clarifying Lawful Overseas Use of Data Act (CLOUD Act) (2018) obliges American companies to hand over customer data under their possession, custody or control, regardless of where it is stored.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Physical location does not shield data from U.S. jurisdiction. The parent company&#8217;s U.S. jurisdiction supersedes data residency. For instance, France\u2019s highest administrative court, the Conseil d\u2019Etat ruled that a Luxembourg subsidiary of AWS is subject to U.S. authorities\u2019&nbsp; requests despite hosting data only in Germany and France.<\/li>\n\n\n\n<li>Encryption can be an impractical approach to data sovereignty, as it comes with a cost in performance, and the provider is still required to disclose the encrypted data.<\/li>\n\n\n\n<li>Microsoft France\u2019s own Director of Public and Legal Affairs admitted before the French Senate in June 2025 that he could not guarantee French citizens\u2019 data would never be transferred to U.S. authorities.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The conclusion is stark: while these measures improve security and operational oversight, they do not guarantee true data sovereignty. Only providers outside the reach of U.S. extraterritorial jurisdiction \u2013 European cloud companies \u2013 can offer this assurance.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Beyond Price: What Businesses Should Really Look For<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Many companies still approach cloud decisions with price as the main filter. But Sch\u00e4fer argues this can be a trap:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cFocusing too much on price without understanding the long-term implications \u2013 vendor lock-in, unused features, technical debt \u2013 creates real risks.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Arno Sch\u00e4fer, CEO at UpCloud<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, businesses should prioritize flexibility, transparency, and scalability. For example, UpCloud\u2019s approach of <a href=\"https:\/\/upcloud.com\/global\/products\/zero-cost-egress\/\" target=\"_blank\" rel=\"noreferrer noopener\">no egress fees<\/a> and easy <a href=\"https:\/\/upcloud.com\/global\/docs\/products\/private-cloud\/relocate-server\/\" target=\"_blank\" rel=\"noreferrer noopener\">switching between public and private cloud<\/a> addresses some of the most common pain points customers face.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ultimately, as Sch\u00e4fer notes, \u201cIt\u2019s not just about infrastructure. It\u2019s about enabling your business goals.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">From Hidden Champion to Recognized Force<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Despite strong products, a reputation for reliability, and a loyal customer base, many clients have referred to UpCloud as a \u201chidden champion.\u201d The phrase reflects the company\u2019s ability to quietly outperform expectations \u2013 delivering speed, stability, and service without always being in the spotlight.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For Arno Sch\u00e4fer, this description is both flattering and motivating. It acknowledges the technical excellence and customer trust that UpCloud has earned, but also points to a gap in visibility. Bridging that gap is central to Sch\u00e4fer\u2019s vision. That means strengthening UpCloud\u2019s brand presence, expanding partnerships, and ensuring the company\u2019s values \u2013 transparency, sovereignty, and customer-first innovation \u2013 are clearly understood across industries.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ultimately, Sch\u00e4fer wants decision-makers across Europe to see UpCloud not as a niche player, but as a strategic partner, capable of shaping their long-term cloud strategies.
